Tom Pye is an experienced trial lawyer who has been helping people obtain resolutions to their probate disputes since 1971. When an individual passes away with a will, a person who has been named executor files the will with the probate court. The executor asks the court to approve the documents as the last will and testament of the deceased and to appoint the petitioner to administer the estate. Our firm represents executors throughout this process and assists these individuals in closing the estate.
Throughout the probate process, there are generally two types of situations that require litigation. Our firm has substantial knowledge in each and can assist when:
- An individual has been excluded from the will and does not receive the inheritance they believe they should receive: This will contest can be pursued on grounds that the will was not properly signed and executed, the deceased was incompetent while making the will or the testator was the subject of undue influence.
- An individual does not believe an executor, administrator or trustee is carrying out the instructions of the will or trust as directed: A will or trust contest can be pursued on grounds that the individual is stealing from the estate, is not managing the estate properly or the person bringing the lawsuit has not received what they are due under the will or trust.
